Neuhausen in rebellion: high-rise dispute goes into the next round!

Things are simmering in Neuhausen - the dispute over the construction project at the former parcel post office hall continues to progress. There are two 155 meter high skyscrapers on the agenda here that have been agitating people for years. While the Büschl group of companies wants to push ahead with construction, opponents of the project, led by the “Hochhausstop” initiative, are on the barricade. Despite a devastating setback in the legal battle, they are not giving up.

The Munich Administrative Court has now decided in an urgent procedure that no interim order will be issued against the development plan. But the initiative, which is supported by CSU state parliament member Robert Brannekämper, plans to appeal this decision to the Bavarian Administrative Court (VGH). According to tz, Brannekämper could file the complaint as early as next week.

Legal disputes

The setbacks for high-rise opponents should not be underestimated. The citizens' petition was rejected by the city of Munich as inadmissible. The initiative had reached a quorum of around 33,000 signatures and wanted to ensure that no high-rise buildings over 60 meters tall could be built in Neuhausen. However, the judges at the administrative court expressed considerable doubts about the admissibility of the request and viewed the question as unclear and misleading. Against this background, the plan to issue a court order against the rejection of the citizens' petition is seen as a challenge.BR

Mayor Dieter Reiter (SPD) reiterated the importance of the planning process, which is intended to create a total of 1,200 apartments and 3,000 jobs. A large part of the city council is already in favor of the new high-rise buildings, which makes the situation even more difficult for the initiative. “There is something going on,” says Brannekämper, who hopes for a quick verdict from the VGH, possibly in November.Süddeutsche

Political dimensions

The political fronts are clearly drawn. Numerous factions support the ideas of the high-rise opponents, while others, such as the FDP, consider the citizens' initiative to be illegitimate. In the future, the question of the construction project could concern Munich citizens again if the court rules against the high-rise opponents. However, if there is another defeat in court, the construction of the towers will probably have finally failed due to the deadlines.

 

It is difficult to predict what time will bring. The statutory resolution for the development plan was originally scheduled for October 29th, but was postponed to wait for the VGH's decision. The city has not yet given a specific date for the start of construction, as this depends on the legal force of the development plan, while the high-rise opponents continue their fight at the political and legal level.
